Welcome to EMORTAL. These Terms of Service ("Terms") govern your access to and use of emortalshop.com (the "Site") and your purchase of products and services from EMORTAL.

By visiting our Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms. Please read them carefully before using the Site.

ONLINE STORE TERMS

By using this Site, you represent that you are at least the age of majority in your state or place of residence, or that you have permission from a parent or legal guardian to use the Site.

You may not use our products, Site, or services for any unlawful or unauthorized purpose or violate any applicable laws in connection with your use of the Site.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to the Site when reasonably necessary, including in cases of suspected fraud, misuse, unauthorized resale, or violation of these Terms.

PRODUCTS & AVAILABILITY

EMORTAL produces and sells apparel, headwear, accessories, collectibles, and other goods, including limited-run and collaborative products.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, modify product specifications, or withdraw products from sale without prior notice.

Because some EMORTAL products use garment-dyeing, washing, distressing, leather, handmade construction, or other production processes that create natural variation, individual products may vary slightly in color, texture, finish, measurements, or appearance.

These variations are part of the character of the product and are not necessarily considered defects.

PRODUCT COLORS & IMAGES

We make reasonable efforts to accurately display our products, including their colors, materials, details, and appearance.

However, colors and appearance may vary depending on your device, display settings, lighting conditions, photography, and natural variations in materials or manufacturing.

We cannot guarantee that the color displayed on your device will exactly match the physical product.

PRICING

Prices displayed on the Site are subject to change without notice.

We reserve the right to correct pricing errors, product-description errors, promotional errors, or other inaccuracies.

If an error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected order.

Applicable sales tax will be calculated at checkout based on the shipping destination and applicable tax requirements.

ORDERS

Placing an order does not guarantee acceptance of that order.

We reserve the right to refuse, limit, or cancel an order for reasons including product availability, pricing or listing errors, suspected fraud, payment issues, unauthorized resale, or other circumstances that reasonably require cancellation.

If we cancel an order after payment has been processed, the applicable amount will be refunded to the original payment method.

You agree to provide current, complete, and accurate purchase, billing, shipping, and contact information when placing an order.

PAYMENT

Payments are processed through Shopify and available third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your purchase.

EMORTAL does not directly store your complete credit or debit card information.

SHIPPING

We currently ship within the United States and to select international destinations, including Canada.

Available shipping methods, rates, and estimated delivery times are displayed at checkout.

Orders of $80 USD or more qualify for free standard shipping within the United States, unless otherwise stated during a promotion.

Customers are responsible for providing a complete and accurate shipping address. EMORTAL is not responsible for delays or delivery problems resulting from incorrect or incomplete information submitted by the customer.

International customers are responsible for applicable duties, import taxes, customs charges, brokerage fees, or other charges assessed by the destination country or carrier unless otherwise stated at checkout.

Shipping and delivery estimates are not guarantees and may be affected by carrier delays, weather, customs processing, holidays, or circumstances outside EMORTAL's reasonable control.

RETURNS, EXCHANGES & STORE CREDIT

Returns, exchanges, store credit, and final-sale merchandise are governed by our current Refund Policy.

Please review the Refund Policy before completing your purchase.

Items must meet the eligibility requirements stated in the Refund Policy to qualify for return, exchange, or store credit.

Sale, promotional, limited-release, or other merchandise identified as final sale may not be eligible for return or exchange.

ACCOUNTS

If you create an account with EMORTAL, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to provide accurate information and to promptly update information when necessary.

We reserve the right to suspend or terminate accounts reasonably believed to be associated with fraud, misuse of the Site, unauthorized activity, or violations of these Terms.

You retain ownership of your original content.

When you intentionally submit content to EMORTAL for publication, promotion, reposting, or use in connection with our business, you grant EMORTAL a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that content for those purposes, subject to applicable law.

EMORTAL does not control third-party websites or services and is not responsible for their content, availability, security, or privacy practices.
